USDA published the new REAP rule on October 1 and it takes effect October 16. A system now has to be built and running before the application, which carries twelve months of real production data. Ground mount solar on certified cropland is no longer eligible.

Florida's investor-owned utilities met the October 1 deadline in two different ways. FPL filed that its approved 2026 to 2029 rate structure already complies, while Tampa Electric filed a new tariff a day early. The Commission now reviews both.

Senate Bill 484 gives every Florida utility until October 1 to file a tariff showing that data centers pay their own cost of service. FPL's schedules have been in force since January, with a 20-year term and 70 percent take-or-pay. The state's consumer advocate says Duke's proposal does not comply.

The North Carolina Utilities Commission denied Duke Energy a 255 MW gas turbine at the Smith Energy Complex on September 18, at a proposed cost of $584 million. The order says much of the projected growth rests on anticipated data center additions and is insufficiently reliable to act on.

Three rules decide what a commercial solar credit is worth after the first year. The depreciable basis falls by half the credit under section 50(c). Credit the business cannot use carries back one year and forward twenty. And selling or scrapping the system inside five years claws part of it back.

Florida
Duke Energy Florida has asked the Public Service Commission to lower rates from January 2027, with commercial and industrial bills falling 0.8 to 3.6 percent. The same utility has filed Florida's first large load tariff under Senate Bill 484, and the Commission's decision is expected in November. A small cut leaves the case for owning generation where it was.

The domestic content bonus adds up to ten percentage points to the federal investment credit for a solar or storage project built with American steel, iron and manufactured products. A system under 1 MW gets the full ten points without the wage and apprenticeship test, and IRS safe harbor tables make the math workable.

Since June, Georgia Power bills carry the fuel and storm cost settlement approved in the spring: about $285 million a year in savings statewide, a storm recovery request cut by roughly 60 percent, and base rates frozen through 2028. Fuel and storm charges sit outside the freeze.

USDA's September forecast, read by Farm Bureau economists, puts 2026 farm production expenses at $492.8 billion, up $21.2 billion, with fuel up 28.8 percent and net farm income down 2.6 percent. Most of those lines are set by markets. The power bill on a poultry house is the one a farm can engineer.

In five days Georgia Power announced PSC approval of seven solar contracts totaling 1,137 MW, its largest single solar procurement, and commercial operation of the 128 MW Robins battery, with nine more storage sites approved for over 3,000 MW. The utility is buying four-hour storage beside solar. The same arithmetic works on a business roof.

On September 14 North Carolina's Attorney General asked the Utilities Commission to create a dedicated rate class for Duke Energy's data center customers, publish Duke's template contracts, move load forecasts to every 90 days and pause new gas plants until the forecasts are re-read. Duke says 80% of its new demand comes from data centers and large users.
